FaceGuessr respects copyright. Much of the imagery in the game is submitted by users, and we remove infringing material promptly when we are notified. This page explains how to send a takedown notice, how to dispute one, and what happens to accounts that repeatedly infringe.
1. Designated agent
Send copyright notices to our designated agent:
- DMCA Agent
- Kinetic Pathways LLC
- 4030 Wake Forest Rd Ste 349, Raleigh, NC 27609
- (917) 750-8577
- faceguessr@gmail.com
Email is the fastest route and is monitored. Please put “DMCA” in the subject line.
2. How to file a takedown notice
To be effective, a notice must include all six elements required by 17 U.S.C. § 512(c)(3):
- Your physical or electronic signature.
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material you want removed, with enough detail for us to find it — a direct URL to the page or image is best.
- Your contact information: name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
Please note that under § 512(f) you may be liable for damages, including costs and attorneys' fees, if you knowingly misrepresent that material is infringing.
3. What we do when we receive a notice
- We remove or disable access to the material expeditiously, which in practice means it stops appearing in games as soon as we process the notice.
- We notify the user who submitted it, pass along your notice, and tell them how to file a counter-notice.
- We record a strike against that user's account under our repeat-infringer policy below.
4. Counter-notice
If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the agent above containing: your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; and your name, address, and telephone number, together with consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any district in which we may be found) and consent to accept service of process from the party who filed the notice.
If we receive a valid counter-notice we will forward it to the original complainant. Unless they notify us that they have filed an action seeking a court order, we may restore the material in 10 to 14 business days.
5. Repeat infringer policy
We terminate accounts that repeatedly infringe. An account that receives 3 valid takedown notices within 365 days is terminated and barred from submitting further content. Strikes withdrawn by the complainant, or resolved in the user's favour through a counter-notice, do not count. We may also terminate an account immediately for a single egregious or deliberate infringement.
6. Submitting images to FaceGuessr
When you submit an image you confirm that you have the right to do so. The Terms of Service set out the rules for personal photos, which must be of yourself, and for celebrity submissions. Submissions are reviewed before they appear in the game, and we reject material that carries a visible watermark, credit line, or other indication that it belongs to a photo agency or professional photographer.
7. Likeness, privacy, and other non-copyright claims
Copyright is not the only reason an image might need to come down. If you are the person shown in a photo, or you represent them, you do not need to file a DMCA notice — email faceguessr@gmail.com or use the report link shown during a round, and the photo leaves circulation immediately. That route also covers publicity and privacy rights, images of minors, and non-consensual imagery, and it is faster than a copyright notice.
Trademark concerns, and requests from agents or representatives on behalf of a public figure, can also go to faceguessr@gmail.com.
